Crypto amplified financial risks in emerging markets: BIS papers

The central banks of the United States, Canada, Mexico and Brazil have pointed out the risks of crypto but warned against excessively prohibitive laws. Cryptocurrencies like Bitcoin (BTC) have failed to reduce but rather have “amplified financial risks” in less developed economies, according to a new study published by the The Bank for International Settlements (BIS). On Aug. 22, the Consultative Group of Directors of Financial Stability (CGDFS) released a new report on cryptocurrencies, titled “Financial stability risks from crypto assets in emerging market economies.” The study was conducted by BIS member central banks within the CGDFS, including those in Argentina, Brazil, Canada, Chile, Colombia, Mexico, Peru and the United States. Ripple Labs bites back against SEC's request to file appeal

Image
Ripple’s chief legal officer said no “extraordinary circumstance” in the case exists which warrants the Court to accept the SEC’s request for leave. Ripple Labs has voiced its opposition towards the United States securities regulator’s move towards filing an interlocutory appeal relating to the summary judgment laid down by U.S. District Court Judge Analisa Torres on Jul. 13. In an Aug. 16 letter to Torres of the Southern District of New York, Ripple’s lawyers explained that because the Securities and Exchange Commission failed to satisfy elements of the Howey test relating to Ripple’s distribution of XRP — a “legal question” — the Court should reject the SEC’s motion for leave to file an interlocutory appeal. An interlocutory appeal occurs when a ruling by a trial court is appeal ed while other aspects of the case are still proceeding and are only allowed under specific circumstances. Ripple’s lawyers believe it is more appropriate for the SEC to appeal the Court’s ruling after a f...

OPNX launches ‘oUSD’ credit currency for crypto margin trading

Image
The new “credit currency” will allow users to rely on cryptocurrencies as collateral without needing to obtain loans from other institutions. Crypto futures exchange OPNX has launched a credit currency for margin trading , according to a July 5 statement made to Cointelegraph from the exchange’s co-founder, Mark Lamb. Called “oUSD,” the currency is available in its “phase 1” iteration, meaning that users cannot receive it without depositing crypto assets into the exchange.  In a future “phase 2” version, the platform intends to make oUSD available to users who deposit crypto into on-chain contracts to allow for possible “bankruptcy remoteness,” Lamb stated. In the currency’s litepaper, oUSD is identified as a solution to three problems. First, lenders do not want to trust platforms to hold cash loans backed by crypto collateral. Second, exchanges and lending platforms don’t want to lend cash to margin traders, as this practice led to multiple bankruptcies during the 2022 bear mar...

Gemini considers forbearance after DCG defaults on a $630M payment

Gemini is planning to file a new motion with the court seeking the return of $1.1 billion of digital assets from DCG-owned Genesis. Troubled cryptocurrency exchange Gemini is considering a forbearance option against the Digital Currency Group (DCG), which missed a $630 million re payment last week. When a lender grants forbearance , the borrower can temporarily reduce its mortgage payment or temporarily stop making payment s. The borrower must subsequently pay the reduced or paused payment s. In its updated response, Gemini claimed that the forbearance consideration would be partly based on whether DCG will engage in good-faith negotiations on a consensual deal. If an agreement cannot be reached among the involved parties, Gemini plans to work with DCG-owned Genesis Capital to suggest terms for an amended plan of reorganization that could be advanced without DCG’s consensual participation. On May 19, Genesis also filed a motion with the bankruptcy court seeking to extend its peri...

White House advisors renew push for 30% digital mining energy tax

Image
The May 2 blog post by the White House’s Council of Economic Advisers (CEA) has already attracted strong criticism from the community. The Biden administration has renewed its push for a 30% Digital Asset Mining Energy (DAME) tax on cryptocurrency miners, part of efforts to minimize the industry’s alleged impact on climate change.  The proposed crypto-mining tax was first announced on March 9 as part of President Biden's FY2024 budget and seeks to impose a phased-in 30% excise tax on electricity used by crypto-miners. Today the CEA released a blog highlighting a new tax in the President’s budget, the Digital Asset Mining Excise Tax (“DAME Tax”), a tax equal to 30 percent of the cost of the electricity cryptominers use once fully phased in. 1/ https://t.co/944x0wVVB5 — Council of Economic Advisers (@WhiteHouseCEA) May 2, 2023 “An excise tax on electricity usage by digital asset miners could reduce mining activity along with its associated environmental impacts and other harms,”...

State caps or federal regulation: What's next for political crypto donations

Image
The industry isn’t having the best of its moments now, but the topic of campaign donations in crypto remains a relatively safe space for innovation. On Jan. 25, the Committee on Elections introduced a bill to the Kansas House of Representatives aimed at capping political donation s via crypto at $100. Regardless of the success of this legislative initiative, the state of Kanzas won’t be the first jurisdiction to target anonymous donation s. From authoritarian nations like Russia or China to electoral democracies like Ireland or Canada, one can find recent attempts to ban crypto donation s to politicians all around the globe.  The opponents of crypto may have a strong point — it’s hard to imagine a healthy democracy where large sums of untraceable money are flowing between candidates. But the problem of “dark money” and tools to dispense it around the political system existed way before pseudonymous crypto assets arrived. The industry isn’t having the best of its moments now, but ...

DeFi platforms can comply with regulations without compromising privacy — Web3 exec

Zero knowledge proofs, DIDs, and more could help DeFi protocols maintain regulatory compliance without exposing their users. Decentralized finance (DeFi) has been a rapidly growing sector of the cryptocurrency industry, but it has also faced significant regulatory challenges. With regulators struggling to keep up with the pace of innovation, the lack of clarity around regulation s tends to create uncertainty for DeFi projects. Cointelegraph spoke to Alastair Johnson about regulatory challenges facing the DeFi industry. Johnson is the CEO of an identity “super-wallet” called Nuggets that seeks to deliver verified self-sovereign decentralized identities to users. He said that one of the main regulatory challenges is DeFi platform anonymity, which makes it difficult to comply with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulation s.  Although privacy is a cornerstone of DeFi, regulatory compliance is essential to protect users and ensure that DeFi platforms are operat...

Stablecoin issuer Paxos reportedly probed by New York regulators

While the exact reason for the investigation hasn’t been revealed, it has been reported that the New York regulator plans on upping its efforts to protect consumers this year. Paxos Trust Company — the New York-based Stablecoin issuer behind Binance USD (BUSD) and Paxos Dollar (USDP) — is report edly being investigated by the New York Department of Financial Services (NYDFS). A “person familiar with the matter” told Bloomberg in a Feb. 10 report that the exact motive behind the probe is currently unclear. An NYDFS spokesperson declined to comment on ongoing investigations but noted that the department is broadly working to protect consumers from risks associated with investing in the cryptocurrency market: “The department is in continuous contact with regulated entities to understand vulnerabilities and risks to consumers and the institutions themselves from crypto market volatility we are experiencing.” Paxos has issued BUSD — a U.S. Dollar-collateralized stablecoin — since the firm...

The world must take a 'collective action' approach to regulations – suggests India’s Finance Minister

Nirmala Sitharaman hopes that finance ministers and central bank governors will be able to agree on crypto regulations in the G-20 meeting in Bengaluru later this month. India’s Finance Minister, Nirmala Sitharaman, stated that regulation “cannot be done” by a single country, it requires “collective action,” in a recent television interview. Speaking to Rahul Joshi on CNBC-TV18 in India on Feb. 3, Sitharaman noted that while the central bank is the “authority for issuing cryptocurrency,” the rest of the digital assets created outside are “using very useful financial technologies.” Sitharaman said that India is looking at a "global" standard operating procedure (SOP) to be “agreed upon” for regulating crypto assets, ahead of India hosting the G20 Finance Ministers and Central Bank Governors meeting in Bengaluru later this month. She suggested that crypto regulations will only be effective if there is global consensus on them. She noted: “Regulation cannot be done by any one c...
